You agree that we will not be liable to you or any third party for any modification to or withdrawal of our/this website.

These trading terms & conditions supersede any previous negotiations or written terms. We also reserve the right to alter our terms and conditions from time to time.

Making A Purchase Making a purchase could not be easier, you can either place your order by telephone or use our secure online web store. Just browse our store, and add any items that you wish to buy into the shopping cart. After you have finished your selection, click on 'Checkout' and you will be asked for a few details that we need to be able to complete the order.

We accept credit card payments. If you are shopping from outside of the United Kingdom, place your order and your credit card company will convert the transaction to your own currency. Check with your card issuer for their rates and fees for international transactions.

We accept Visa (including Visa Electron), MasterCard, American Express, JCB and Maestro credit card payment and your card will be immediately charged after your purchase. Payments are processed securely by Protx Secure Online Payment services. If at any time Protx payment systems are unavailable, we will switch our website to accept SSL encrypted payment orders, which we will then manually process. You may also send your credit card information via phone, fax, or ordinary post.

We accept personal and company cheques in sterling GBP, however they need to have been cleared before goods are dispatched. This usually takes 3 - 5 working days. If a trade credit account has been applied for and granted, we will grant a period of 30 days settlement from the date of invoice.

We trade in sterling GBP.

When confirmation of order is received, this is to indicate that we have received your order. This does not however, constitute a binding acceptance of your order nor does it imply that a contract exists between us. We are under no obligation to accept your order. We will indicate acceptance of your order, and hence a contract between us, when we send you an invoice. We have included this term to protect us in the case that a mistake has been made in pricing, we have inadvertently under-priced goods, or we are no longer able to supply a particular product for some reason. In the case of a change of price, we will always contact you first to ensure that the price is acceptable.

If in the exceptional circumstance we take your order for an item, but run out of stock prior to your order being dispatched, we will back order the item for you. We will then email or telephone you with an expected availability date and the option to cancel if you would rather not wait.

Whilst we take extreme care to ensure product descriptions, images, information and prices are accurate, we do not accept liability for any inaccuracies, errors or omissions. Products are available while stocks last and all prices (including shipping & handling) are subject to change without notification.

All orders and communications with us must be in English and all contracts concluded between us will be in English.

If we issue or decide to accept a user name and password login for our/this site, it is your responsibility to protect against unauthorised use by keeping these details confidential. Be sure to log off when using a shared computer.
Shipping And Handling All goods are subject to postage and packaging. In the case of our online store, this will be added to your order automatically depending upon the weight and/Or destination of goods (Note: the weight of your order is automatically calculated when placed). For telephone orders, we will advise of our current delivery tariff when you place your order. We will also endeavour to maintain a current copy of our delivery tariff on our/this website. If you are a UK retail (non trade) customer and the total value of your order is over £16.95, we are pleased to offer Free Shipping on eligible orders.

Eligible Order Definition (Free Delivery Retail):
If your order value is over £16.95 and you are not a trade customer, enter the words FREE UK DELIVERY in the coupon box provided at the checkout page. This will deduct our £3.50 standard retail delivery charge. * Your whole order must be able to be shipped together at the same time to a single UK address. Please note if your order is eligible for Free UK delivery, you must type FREE UK DELIVERY in the coupon box at the checkout in order for our standard delivery charge to be deducted correctly. If your order is eligible for Free UK delivery and you do not type FREE UK DELIVERY in the coupon box at the checkout, you will not benefit from our free delivery offer. UK orders placed without entering this coupon code will be charged at our standard delivery rate. Simon Smith Explanations Ltd will not be liable for retrospective free postage claims.

We also offer free shipping on UK only trade orders over £150, delivered within the UK.

Eligible Order Definition (Free Delivery Trade):
If you are a UK trade customer and your total order value is over £150.* Your whole order must be able to be shipped together at the same time to a single UK address.

Trade orders require a trade log in account. Please telephone 01483 225632 for further details on trade accounts.


* In the unlikely event of stock shortages, we will advise within 24 hours to give you the option to A: receive part of your order (depending upon order value), B: cancel your order or C: wait until your whole order is ready to ship together. Please note; canceling items within your order might affect your order's eligibility for Free UK Delivery.
Delivery Schedule We will endeavor to dispatch your order right away if the order is received before 1.30pm (GMT) and is in stock. Exceptions to this order cut off time for a particular product, will be indicated within the product description itself. Large international orders are usually dispatched the following day. We will normally send your order to you in 3 business days. International orders are generally received in less than 20 days. Some products are dispatched directly from the distributor.

Please note we do not despatch any parcels on Saturday, Sundays or Bank holidays. All of our delivery services require proof of delivery in all cases, so please ensure that a person will be available to sign for the parcel. If no-one is available to sign for a parcel, it is usual practice that the Courier or Postal Service will leave a card explaining how the parcel can be collected.

Whilst every effort will be made to ensure the goods are delivered within the stated time, no liability can be accepted for any delays.

Please note; we do not deliver to P.O.Boxes (post office boxes).

CUSTOMS INFORMATION FOR INTERNATIONAL ORDERS

The responsibility for payment of custom duties rests with the customer. Deliveries to some countries may be delayed by customs. We reserve the right not to deliver to some countries if we consider there is a risk that you will not receive your order.
Back Orders If your item is not in stock, we will back order for you. You will always be emailed or telephoned with an expected availability date and the option to cancel your order if you would rather not wait.
Tax Charges All orders from Simon Smith Explanations Ltd at the present time are VAT free.
Credit Card Security Simon Smith Explanations Ltd takes the security of your personal and credit card details very seriously. When the order is placed at our/this website, credit card numbers are encrypted using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site.

We also take the further additional step of encrypting your personal details such as your name and address as you are taken to a secure page the moment you enter our checkout. You will notice that a small golden padlock appears in the bottom of your browser window and the address in your browser's address bar changes from http to https. This indicates that you have changed to a secure, encrypted server and that a secure socket layer (SSL) is in place.
Guarantee We guarantee your satisfaction. All of our products come with a 12 month guarantee against manufacturing defects from date of purchase (please note this does not include wear and tear or breakages).

Returns Policy TO RETURN FAULTY OR DAMAGED GOODS

Please notify us immediately upon receipt of any damage to your goods. In the unlikely event of loss or damage to your ordered goods, we will supply replacements free of charge. After a period of 7 days, damage will be assumed to have occurred after delivery. Where replacements are not available, a full refund will be offered.

TO RETURN NON -FAULTY / NON DAMAGED GOODS

Should you wish to cancel your order before it has been shipped, please contact us by email immediately at sales@simonsmithexplanations.co.uk or telephone us on 01483 225632 (Please note; canceling items within your order might affect your order's eligibility for Free UK Delivery).

You may cancel your order by informing us of this in writing any time up to seven days from the day after the day of delivery. Goods are to be returned to us at your expense in an UNUSED, UNOPENED, condition without the seals or wrapping being removed or broken. Any goods returned to Simon Smith Explanations Ltd, other than faulty/damaged items will be subject to a 20% restocking and administration charge. We will refund your money within 30 days of receipt of the goods or within 30 days of your cancellation, whichever is the earlier. We regret we cannot accept responsibility for shipping costs. Refunds due will be for goods only, minus any shipping, restocking and administration charge. Returned goods are to be accompanied by a note showing your name and address, the date of order and the order number, and should be forwarded to us at the address shown under the 'Reaching Us' section within these terms & conditions. Please ensure that you return them via an appropriate method of insured or courier transit as we do not accept liability until received by us. If you do not pay for the goods to be returned to us, a deduction will be made from your refund to cover our costs for collecting the goods/postal charges.

Your rights to return goods are protected under the EU Distance Selling Directive which can be found at http://www.hmso.gov.uk/si/si2000/20002334.htm
Trade Accounts Bona-fide Retailers/Music Shops may apply for a trade credit account. Subject to your application for credit being accepted by us (and following completion of our application for credit form/process and your acceptance of our terms and conditions), we will grant a period of 30 days settlement from the date of invoice. Please note that goods remain the property of Simon Smith Explanations Ltd until accounts are settled in full. Any SRP Prices quoted are for guidance.

Overdue accounts - We reserve the right to charge interest on any overdue accounts. Further supplies of goods may be withheld until these payments and dues are settled in full.
